1. Agreement to Terms

By accessing or using Forge at letsforge.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Forge is developed and operated from Texas, United States. These Terms are governed by the laws of the State of Texas.

2. Description of Service

Forge is an AI model debate platform that allows users to orchestrate discussions between multiple AI models. The Service enables users to:

  • Create and manage debates between different AI models
  • Access various AI models through our platform
  • Store and review debate history
  • Use their own API keys for certain models (BYOK)

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent.

4. Subscription and Payments

4.1 Free Tier

We offer a free tier with limited credits. Free tier usage is subject to fair use limits and may be modified at our discretion.

4.2 Paid Subscriptions

Paid subscriptions ("Pro" tier) provide additional credits and features. By subscribing, you agree to:

  • Pay the applicable subscription fees
  • Automatic renewal unless cancelled before the renewal date
  • Provide accurate billing information

4.3 Credits

Credits are used to access AI models through the Service. Credits:

  • Are non-transferable and have no cash value
  • May expire or reset based on your subscription tier
  • Cannot be refunded once used

4.4 Refunds

Subscription fees are generally non-refundable. However, we may provide refunds at our discretion for:

  • Service outages exceeding 24 hours
  • Billing errors
  • Other circumstances we deem appropriate

4.5 Price Changes

We reserve the right to modify subscription prices. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.

5. Acceptable Use

You agree NOT to use the Service to:

  • Generate illegal, harmful, threatening, abusive, or harassing content
  • Create content that violates any person's rights, including intellectual property rights
  • Attempt to bypass usage limits or security measures
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated systems to access the Service in a manner that exceeds reasonable use
  • Impersonate others or misrepresent your affiliation
  • Distribute malware or engage in phishing
  • Generate content that sexualizes minors
  • Generate spam or bulk unsolicited messages
  • Attempt to manipulate AI models to produce harmful outputs

We reserve the right to suspend or terminate accounts that violate these guidelines.

6. AI-Generated Content

6.1 No Guarantee of Accuracy

AI models may produce inaccurate, biased, or inappropriate content. The Service is provided for informational and entertainment purposes. You should not rely on AI-generated content for:

  • Medical, legal, or financial advice
  • Safety-critical decisions
  • Factual accuracy without verification

6.2 Content Ownership

You retain ownership of the prompts you submit. AI-generated responses are provided under the terms of the respective AI providers. You may use AI-generated content subject to:

  • These Terms of Service
  • The terms of the underlying AI providers (OpenAI, Anthropic, Google, etc.)
  • Applicable laws and regulations

6.3 Content Moderation

We may review, filter, or remove content that violates our policies. AI providers may also apply their own content moderation.

7. Third-Party Services

The Service integrates with third-party services including:

  • AI Providers: OpenRouter, OpenAI, Anthropic, Google, Meta, and others
  • Authentication: Google OAuth, Microsoft OAuth
  • Payments: Stripe
  • Infrastructure: Supabase, Vercel

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service availability or conduct.

8. Bring Your Own Key (BYOK)

If you use your own API keys:

  • You are responsible for all charges from the API provider
  • You must comply with the API provider's terms of service
  • We encrypt your keys but cannot guarantee absolute security
  • You should use API keys with appropriate rate limits and spending caps

9. Intellectual Property

9.1 Our Property

The Service, including its design, features, and code, is owned by Forge and protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.

9.2 Feedback

If you provide feedback or suggestions about the Service, you grant us a non-exclusive, royalty-free license to use that feedback for any purpose.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT
  • UNINTERRUPTED OR ERROR-FREE OPERATION

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORGE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • Loss of profits, data, or goodwill
  • Service interruptions
  • AI-generated content that is inaccurate or harmful
  • Unauthorized access to your account
  • Third-party service failures

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Forge, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you generate or submit through the Service

13. Termination

We may suspend or terminate your access to the Service at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Extended periods of inactivity
  • Any other reason at our discretion with reasonable notice

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases, but certain provisions of these Terms survive.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in court for intellectual property violations.

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

16. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and Forge regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Our failure to enforce a right does not waive that right.
  • Assignment: You may not assign these Terms without our consent. We may assign our rights freely.
  • Force Majeure: We are not liable for failures due to circumstances beyond our reasonable control.
